TERMS AND CONDITIONS OF BROWNS PLUMBING

Browns Plumbing Terms and Conditions compose of a legally binding agreement between the client and any person acting on the behalf and with authority to Browns Plumbing
It is exclusively the responsibility of the client to comprehensively read Browns Plumbing’s terms and conditions before undertaking any works.
Browns Plumbing reserves the right to review and make changes to these terms and conditions at any time.

Payment and Price
Payments – The Client will pay for all work in full at the completion of the job unless other arrangements have been made in writing by Browns Plumbing. A 50% deposit may be requested at the discretion of Browns Plumbing for larger jobs eg. renovations, and the balance to be paid at completion.

Payment can be made by Cash, Cheque, EFT, Credit Card or Zip Pay. All EFT payments are required to use the Invoice number as reference and a remittance sent to admin@browns-plumbing.com.au

Any late payments outside of our terms are subject to a monthly charge of 10% of the amount outstanding, until payment is received in full. If any invoice remains unpaid by the Client for a period of 30 days or more, Browns Plumbing reserves the right to pass on the account to a Third-Party Debt Collector Agent. Any further fees charged by the Debt Collector will be passed on to the Client for payment

Goods – All Goods remain the property of Browns Plumbing until payment is received in full.

Charges – All work is charged to the Client at an hourly rate for labour or part thereof after the first hour, plus any materials or special equipment used. These charges include GST. These charges are subject to change without notification to the Client.

Call Out Fees – During the normal business hours of 7.30am – 4.00pm weekdays, there is no call out fee charged to the Client, just a minimum of the first hour labour. If work is carried out outside of these hours eg. On the weekend – a call out fee will be charged.

Cancellation/Missed Appointment – If an appointment is made between the Client and Browns Plumbing and the Client fails to attend or cancel the appointment 24 hours prior, a minimum charge of one hour’s labour will be payable to Browns Plumbing by the Client.

Defects
It is the responsibility of the Client to inspect the works and goods on completion. If a defect or damage is noticed upon completion, the Client will notify Browns Plumbing within 7 days and allow them the opportunity to rectify to Australian Standards. Further charges to rectify the issues, will be passed on to the Client if the fault is not that of Browns Plumbing

Third-Party Suppliers
Goods and services of third parties have been included on the website of Browns Plumbing. It is the responsibility of the Client to refer to the supplier’s website for specifications and warranties. Browns Plumbing will not be held liable for any dealings or interactions with Third Party Suppliers or their products. All product warranties are that of the Third-Party Supplier

Quotes
All quotes are valid for a period of 30 days and are priced on labour and materials to be used. All quotes are subject to the following exclusions:
– Repair of any unforeseen services
– Alterations of any other services
– Any after-hours work
– Any additional works or variations not included in the quote shall be at the cost of the Client. All variations to an accepted quote must be in writing and agreed upon by an authorised person of Browns Plumbing

Any sight-unseen quotes given over the phone, are subject to change if there is extra work or legal requirements that need to be adhered to that were not advised by the Client.

HWS quotes are for like-to-like replacement – ie – a 135L gas or electric HWS is to be replaced with a new 135L gas or electric HWS in the same position. The existing HWS must be in compliance with current relevant standards and by-laws. If the HWS needs to be moved or gas supply upgraded to comply with relevant standards or by-laws, there will be an extra charge that is to be paid by the Client. The quoted cost does not include the supply or installation of an isolation valve, cold relief or tempering valve if needed. The price does also not include the cost of an electrician to connect or disconnect the electrical supply if needed.

Browns Plumbing will not be held liable for and costs or fees associated with regulatory bodies such as Water Corporation, Atco Gas and Dial Before You Dig.

Unless written in the quote, any excavation of roots, concrete, rocks, limestone or other foreign matter will be charged at an hourly rate to the Client.

If existing soils are excavated, they will be returned to the original location if possible. Any concrete, paving or landscaping works required after job completion are the responsibility of the Client unless specified in writing. If Browns Plumbing re-install pavers at the request of the client, we will not be held liable if they sink in the future.

INTELLECTUAL PROPERTY
If Browns Plumbing have drawn up any plans / sketches for the completion of a quote/job, they remain the property of Browns Plumbing and shall not be used or reproduced without written permission to do so.

WARRANTIES
Workmanship Warranty – Browns Plumbing provide a lifetime workmanship warranty following any works on our labour charge. Should a call back for workmanship be necessary, Browns Plumbing will return between the normal business hours of 7.30am – 4.00pm weekdays. If returning for workmanship outside of these hours, there will be a labour rate charged to the Client. Should the call back be deemed by Browns Plumbing to not be a fault of poor workmanship by Browns Plumbing, the hourly rate of labour and any parts used will be charged to the Client.

Warranty for defect of parts is that of the manufacturer and not Browns Plumbing.
Eg – Hot Water Systems carry their own warranties for different models and different companies. Any warranty claims would need to be directed directly to the manufacturing company. Should Browns Plumbing attend and find the fault is a warranty issue with the manufacturer, a minimum callout rate of one hours labour would still be charged to the Client.

Blocked drains – if Browns Plumbing clear a blocked drain and that drain later becomes blocked again, this is not covered under Workmanship Warranty as the original blockage was removed and this would be a new blockage
Burst pipes – if Browns Plumbing repair/replace a burst pipe and the pipe subsequently bursts in another location, this is not covered under Workmanship Warranty as the burst is in a new location

PERMITS
It is the responsibility of the Client to ensure any necessary permits or notifications to relevant authorities be obtained before they engage Browns Plumbing to perform works

GLOSSARY OF TERMS

AGREEMENT – A negotiated and typically legally binding arrangement between parties as to a course of action.

AGENT – A person who acts on behalf of another person or group.

AUTHORISED – Has permission or approval to do something

BLOCKED DRAIN – When a drain is clogged and water cannot flow down the drain

CALL BACK – The recall of an employee back to a job

CALL OUT – To deal with an emergency or provide a service

CANCELLATION – To make void, as a contract or other obligation

CHARGES – A charge to the client for expenses incurred

CLIENT – The Customer or someone who receives services

COMPLETION – The process of finishing a job

COMPANY – A business or organisation that makes, buys or sells goods or provides services in exchange for money

DEFECT – An imperfection or abnormality that impairs quality, function or utility

EQUIPMENT – The machinery, tools that you need to do a job

EXTRA WORK – Work falling outside the scope of services agreed upon

GOODS – A product that is required to a customer to complete the services

GST – Goods and Services Tax

INSTALLATION – The process of positioning a new system or equipment in its correct place or connected for use

INTELLECTUAL PROPERTY – A product, service, process or idea that belongs to you (Browns Plumbing)

LIABILITY – Legally binding obligations that are payable to another person or entity

PRICE – The amount of money charged for a product or service

SERVICES – Delivering value to the customers by repairing, maintain or providing something to someone

SUPPLIERS – A person or business that provides a product or service to another entity
WARRANTY – A type of guarantee that a manufacturer or similar party makes regarding the condition of its product
